Imagine this: lyrics written in Cebuano describing the Filipinos' delusion to white Christmas sung to the tune of 'Let It Snow! Let It Snow! Let It Snow!'. It's not only brilliant, it's also comical and an eye-opener. 'Wa Tay Snow' means we do not have snow. The context of the lyrics will tell you of almost every Filipino's obsession to the western practices of Christmas.

I would hear foreigners saying how weird it is to see Christmas trees, mock snow, and all the winter-like decors in December inside the hotels and malls in the Philippines when it's oven hot outside. Imagine that. It's not only funny, but stupid - snow, Christmas tree, Santa Claus, reindeers, and so on. We are trying to be what we are not and I think it's a shameful culture.<br />
<br />
And so when I heard the demo, I immediately saw the potential. And I'm sure a lot of people, although they may not admit it, can very much relate to the Filipinos' stupidity of embracing the western practices of Christmas.<br />
<br />
But I advised the songwriter to hold the release of the song while I work on the adaptation license to record it. 'Let It Snow! Let It Snow! Let It Snow!' is originally written by Jule Styne and Sammy Cahn under Cahn Music Publishing Co. (ASCAP). After a few more research work, I ended communicating to Warner Music NY and because the Philippines is in Asia, they forwarded me to their Asian head office in Malaysia. This was a year ago. We had a long email discussion and they charged me PhP25,000 to record and use the song.<br />

I think it's a reasonable rate. However, if we are to invest on the license, it has to be recouped somehow and so I asked what percentage of ownership should they share with us on the new musical work. This is their reply (name of the respondent removed):<br />

I'm not sure if I understood this accurately but nothing happened and Christmas 2012 eventually ended.<br />

This year, I decided to revisit the project and as I was advised, Universal Records turned out to be the copyright administrator of 'Let It Snow' in the Philippines. I managed to contact them. In our email conversation, they again included Warner Music Asia in the thread. This time they charged me USD20,000 (USD not PHP) and after a very long discussion and attempts to persuade on the ownership issue, this is their final response (name of the respondent removed).

<i>Please understand that the rule for adaptation is that you can change the lyrics with prior permission and approval of the owner but that should not diminish or lessen the rights and or the ownership of the intellectual property owner over the song or the musical work, thus owning 100% still to the owner.

<i>In the same way that it doesn't follow that if you create a new lyrics to an existing song, then you already own 50% of the right over the original song because of your creation of the new lyrics. That wouldn't be a fair to the original intellectual property owner.

Though I understand and respect this so-called standard practice, the principle that it promotes actually impedes creative options.<br />
<br />
Creative work is made when artists bend rules, not break them. The copyright law on the other hand is authored to protect these creative works. I believe adaptations can be considered new creative works too. If the Batman story is franchised for a movie, I'm sure the franchisee would never invest on the license if he cannot own the rights to the new story. How is that any different to a musical adaptation?<br />

Had they ever heard of the term Creative Commons? It's a similar idea except that it's non-profit.<br />
<br />
I wish there was a way to negotiate on the terms with the original publisher for us to release 'Wa Tay Snow'. Apparently, the standard practice permits none. It is sad to note that it is by this practice why the record companies are downsizing globally. I'm simply requesting for a different license to a different story of an existing melody. A unique license in fact because after all, copyright law is supposed to be territorial. The irony is that the music industry, being a key player in the creative industry, turns out to be a close minded institution.<br />

I didn't pursue the license.<br />

<br />
This year's theme for the Creative Industries Summit revolved around that premise - the process behind the art. This is because most people, particularly customers, don't see this. A client would ask you to make him a commercial jingle and you'd ask for a fee and he'd reply saying it's expensive for a 30 second song. And so the songwriter explains that putting someone else's idea into a song under constraints such as limited words and suggested phrases is a creative process. God knows how long it takes until the songwriter gets it right. But the client insists that it should still be paid based on the length of the song. And so the argument went on and the songwriter and the business person got lost in the conversation.<br />
<br />
I am listing my personal top 3 speakers of the 2nd Cebu Creative Industries Summit based on how close they have adhered to the topic on creative process (or at least the components of it - ideas, research, intellects, and arguments).<br />
<br />
My no. 3 is a tie between Reese Ruiz-Fernandez and PJ Ong. Both did a fair attempt to explain how their creative juices transcend from an idea to a tangible product.<br />

Education is good and expensive. But learning can sometimes be affordable too. In fact it can be ridiculously cheap to as low as PHP 250, you get inspired from the works and ideas of Dr. Joe Adam Fry (Google UK), Kenneth Cobonpue, Arch't Jason Buensalido, Lloyd Tronco, Insoy Niñal, Butch Carungay, to name a few. The topics of this year's summit revolve around the creative process behind every great design.<br />

Dr. Joe Fry is the Planning Lead in Google's Global Creative Team (known internally as 'The ZOO'), based out of London. His team fosters deep working relationships with global businesses, creative agencies and Google product teams to deliver best practice digital creative work across the web. Joe's role is to lead creative strategy, creative process, and insight. Before joining Google 18 months ago, he acted as a strategic/creative consultant at several independent UK-based Creative Agencies and has a PhD in Creative Process Management.<br />

<b>KENNETH COBONPUE</b><br />
Topic : Inspire | Desire - from inspiration to objects of desire<br />
<br />
Kenneth Cobonpue is a multi-awarded designer and manufacturer from Cebu, and the creative director of Hive. He graduated in Industrial Design from Pratt Institute in New York with highest honors and subsequently worked in Italy and Germany. Integrating locally sourced materials with innovative handmade production processes, Cobonpue's brand is known around the world for its unique designs and roster of clientele that include Hollywood celebrities like Brad Pitt and members of royalty.<br />
<br />
Awards to his credit include 5 Japan Good Design Awards, the grand prize at the Singapore International Design Competition, the Design for Asia Award of Hongkong, the American Society of Interior Design Top Pick selection and the French Coup de Coeur award. Several of his designs were selected for several editions of the International Design Yearbook published in London and New York. The books "& FORK" (Phaidon) and "DESIGN NOW" (Tashen) underscore Kenneth's position as a leader of a new movement incorporating technology and craft. He has appeared on European television, countless international magazines and newspapers around the world. Various Cobonpue designs have also appeared in full-length feature films and television such as Oceans 13 and CSI.<br />
<br />
Kenneth reveals new work each year in design shows from Paris to New York. He also speaks regularly about Southeast Asian design all over the world. In 2007, TIME magazine called him "rattan’s first virtuoso."<br />

<b>Architect JASON BUENSALIDO</b><br />

Arch't Jason has won numerous prestigious competitions, including UP’s Pinakamagandang Bahay sa Balat ng Lupa, and was a finalist/awardee in the CCP’s Arts Theater and Artists Center competition and Bahay Pinoy competition. His firm, Buensalido Architects, is an architectural, interior, and urban design laboratory committed to creating original, avant-garde, innovative, and progressive solutions. Its vision is to broaden and uplift the design profile of the Philippines and share this with others around the globe, thereby helping to put the Philippines on the global design map.<br />

<b>PJ ONG</b><br />
Topic : Experimentation As A Medium Of Graphic Design<br />

PJ Ong has been running his own design studio/art collective known as !NODORO for more than 10 years. He has produced designs for clients both commercial and exhibition works in the fields of arts, music, culture, fashion, print and design. PJ has increased experience in the areas of design, with focus on: Art Direction, Graphic Design, Illustration, Packaging, Graffiti, Consulting, Branding, Identity, Stingers, Strategy, Photography, Video, Motion Design, Custom Typeface, Typography, Art installations. He received his Education at the International Academy of Design & Technology – Toronto. Some of his Awards & Recognition are as Speaker - Visual Design Conference 2011 (Topic: Experimental Arts); Speaker- Pecha Kucha Cebu 2012 (Topic: Digital Design); Nominee - CSS Design Awards 2012 for the !nodoro website (Category: Best Websites in the World). Lorenzo "Insoy" Niñal is a very talented writer, musician, songwriter and well-known champion of original Cebuano music and songwriting. An advocate for education and preserving local culture, one of the recent projects he worked with was VISPOP, a Cebuano Songwriting Campaign & Competition that was organized by Artist KO (Artists & Musicians Marketing Cooperative) in cooperation with FILSCAP (Filipino Society of Composers, Authors and Publishers). As VISPOP education coordinator, Insoy conducted songwriting workshops for young and budding artists to hone and further professionalize their songwriting skills.<br />
<br />
Insoy founded the Cebuano rock band Missing Filemon, of which he is also the songwriter and vocalist. He won the 2008 FAMAS Award for Best Movie Theme Song for his composition “Sine-Sine.” He finished AB Philosophy and AB English at the San Carlos Seminary College in Cebu City. He works as editor of Sun*Star Cebu and as Columnist for Sun*Star Cebu and Sun*Star Superbalita. He teaches Literature and English at the Cebu Normal University, and English at the Seminario Mayor de San Carlos.<br />

<b>JOEL RUIZ</b><br />

Joel is a freelance television commercial director, and an independent filmmaker. He is also resident producer/director and co-founder of Arkeomedia, a production shop that specializes in features and commercial work. He is a graduate of the Mowelfund Film Institute. An award-winning director with several movies under his belt, his previous short works include Mula Sabado, winner at the Gawad-CCP Awards, and Sa Mata ni Chico, winner at the Gawad-CCP and Urian nominee for Best Short Feature.<br />

<b>REESE FERNANDEZ-RUIZ</b><br />

Reese is an innovative and passionate leader who champions revolutionary ideas that would help the world become more sustainable and ethical. She believes that quality and integrity should always go hand in hand. Thus, she became the co-founder and CEO of Rags2Riches Inc., a for-profit social enterprise based in Manila, Philippines, which creates eco-ethical fashion and home accessories out of up cycled scrap cloth, organic materials and indigenous fabrics by working with women living in the poor communities across the country. Rags2Riches’ philosophy stands upon its four bottom lines: People, Profit, Planet and Positive Influence.<br />

The labels in my country continuously failed to explore until the new mold of independent bands thriving without them labels. Independent bands that care only to their fans, how many people could love their music, and putting the album sales as just a bonus option.<br />

Today, many of the local independent bands made their own success stories. They have emotionally moved small yet strong communities efficiently. And what's more interesting is that these bands are really good listeners and explorers.<br />

Forty years because it has been my dream project since high school - to one day sing the songs I knew from childhood myself. Consumatum est!<br /><br />GYUD (which means "indeed", the most-often used Cebuano expression) is a family-builder (now you know the songs of your lolas and lolos) and a community/nation-builder (these incredible songs speak of an incredibly eloquent people!) in one painless dose. Many of the delegates presented their respective accomplishments in terms of revenues, projects, and the services their business can provide. More importantly,it felt that the ASEAN Forum's goal was somewhat biased in favor of promoting Japan's soft power industry and how it has elevated its culture to the world stage.<br />

In this event, the definition of “content”or “content industry” emphasized to mean its most basic form – storytelling. That stories require expressions in varied platforms – music, film,advertisements, animation, and just recently, online games.That content is a major player, although underrated, in the economic growth of a nation. I agree to this.<br />

With the former, it has been and perhaps always a challenge to quantify that content is key to economic sustainability – especially in the Philippines. There is not one story I know to date that has made it to global acceptance. Is it because it’s intangible? Is it because creativity embraces no exact form? Is it because art naturally averts structure? Or it is it because we fail to protect the expression of ideas?<br />

And therefore the Philippines’ content industry consequently resort to copied products.<br />

In my presentation, I attempted to explain the face of the “standard” music industry and my sector’s proposed “new look” with Artist Ko being the frontliner. My speech included milestones in my sector, its seemingly hopeless challenges, and possible avenues for collaborations. After my presentation, a delegate from Brunei inquired about how the organization was established. Mr. Haji Tanaguchi (Chairman, Music Publishers Association of Japan) asked if he could be a member. I took those as positive feedbacks.<br />
<br />
Mr. Aroon James Tan (Magma Studios Pte. Ltd.) caught me as he presented his product called ‘Temasek’, an online game designed to retell the very ancient and almost lost history of Singapore. The game’s goal was to distribute in schools as alternative education tools in history classes. His idea reminded me of Christine Diaz, a Filipino historian retelling the untold stories of the Philippines’ history (I attended a couple of her forums and own a couple of her books)<br />
<br />
Temasek inspired me to think that it would be a wonderful project toretell the truth about our country’s history as an online game.<br />
<br />
While I enjoyed almost every slide from other speakers, the forum I believe failed to address a very important concern which I actually raised – if there is a collaboration to take place between ASEAN in the future, who (or what ASEAN country) should take ownership on the administration? Ms. Nora’in Ali (Head of Culture and Information, ASEAN Secretariat) took my question well and thought it as a goal to address in the future.<br />
<br />
Overall, the forum promoted fresh perspectives on the importance and benefits of creative content. Today, I’m receiving updates via email from the ASEAN Creative Centre promoting their culture through information on upcoming events and activities. He is the Regional Director for the Asia-Pacific of the Confédération Internationale des Sociétés d´Auteurs et Compositeurs (CISAC) or the International Confederation of Authors and Composers Societies. CISAC is the international collective management society that binds all territorial public performance rights in a "standard" platform.<br />

That's pretty serious huh? Nosebleed? That's fine. I suppose that's normal. I didn't get this at first too. But if one is very much acquainted with how the industry of music works, particularly on the field of public performance licensing, one would understand that he's got one of the coolest job in the world.<br />

In Artist Ko's recent FILSCAP forum called <a href="http://myfavoritesins.blogspot.com/2011/10/music-in-your-business.html">"Music In Your Business"</a>, KT dissected the value of music, aside from just enjoying it, as a subliminal tool in businesses.<br />

<li>Classical music used with great success in Montreal to dissuade young people from ‘hanging around’ in the underground</li>
<li>20-year German study on 90,000 patients revealed that music had the effect of reducing drug dosages by as much as 50%</li>
<li>Researchers have found that music affects people, animals & plants in many ways</li>
<li>Stanford University’s School of Medicine found that listening to music might help to sharpen the ability to anticipate events & sustain focus (published in 2007 Neuron journal)</li>
<li>Finnish researchers have found that music could help aid cognitive recovery soon after a stroke (published in February 2008 issue of Brain journal)- verbal memory and focused attention improved significantly more in stroke patients who listened to their favorite music several hours daily than in those patients who listened to audio books or nothing at all</li>
<li>University of Maryland School of Medicine researchers found that the diameter of the average upper arm blood vessel expanded by 26% when subjects listened to music which they selected as joyful (country); but constricted by 6% when they listened to music that made them feel anxious (heavy metal)</li>

For years I dream of a "music industry" for Cebu. To dream is easy. To embark on the mission is another grand story to partake.<br />

There are limitations to this grand plan. But the potential is also considerably strong.<br />

I'm writing this blog to invite the songwriters in Cebu to a get-together on October 28, 2011 at 7PM. First he invited me to his wedding slated in September. Then he asked if I could sing 'Kismet' on that day for him and his bride. Oh really?<br />

Amidst my very hectic schedule, I admittedly got so flattered that I couldn't say no... more so to a very good friend.<br />

If you haven't heard this song yet, turned out to be very appropriate I realized. I'm a wedding singer now (hahaha and I must admit it was fun).<br />

WIPO, IPOPHIL, DTI, Cebu Chamber of Commerce, and Creative Cebu recently sponsored an event called National High Level Forum on Innovation and the Creative Industries Ecosystems. Branding, evolving business models, and the use of intellectual property as its utility belt were the prevalent agenda. Insightful it was, yes. Very informative. Grandly inspiring. I'm writing this entry as an attempt to document the experience and knowledge I've savored in that 2-day forum.<br />

My favorite topics were those presented by Brandon Rawson (1st Act, Silicon Valley, USA), Jason Potts (ARC Centre, Brisbane, Australia), Jay Aldeguer (The Islands Group, Cebu, Philippines), and Kenneth Cobonpue exhibiting all his grand offerings to the world.<br />

And then there was the thought provoking semi-lecture on branding by Mr. Junie del Mundo (CEO, Management Association of the Philippines, Manila). I'm sure there were other speakers that were equally mind-moving but I missed it due to a pre-scheduled separate appointment (had to leave for a couple of hours and came back).<br />
<br />
Bullet pointing all that has transpired, these are the key notes identified in a creative community that caught my fancy:<br />
<ul>
<li>The need to experiment and consequently support it</li>
<li>Customized music business model per region</li>
<li>The empirical ratio between opportunities versus challenges</li>
<li>The empirical ratio between risks versus rewards</li>
<li>The proposed action to rebrand the Philippines (and Cebu as a creative hub)</li>
<li>The need to draft and enforce applicable policies (whatever this may mean to artists and entrepreneurs alike)</li>
<li>And the ironic impact of the use of intellectual property (yes I knew there was a downside to this but couldn't put my finger on it until this forum)</li>
</ul>
I waited for somebody to scale the above a little bit down and bring forth subjects such as:<br />
<ul>
<li>The need to provide more avenues on financial support especially in the experimental phase of creativity where only a few listen, vision-share, and pay attention to</li>
<li>The need to make meaning first - branding via the basic needs on food, clothing, shelter, and transportation</li>
<li>That creativity should include science and engineering ergo not limited to music and arts alone</li>
<li>Is there an existing policy that supports this?</li>
</ul>
Nobody did.<br />
<br />
So I braved in and expressed (and hopefully contributed) some ideas and opinions. Here they are;<br />
<br />
<ul>
<li>The government should be more aware of "existing experiments" going on around them. Unless they figure out a way to tap in these potential resources and fund them, these efforts could end up flourishing elsewhere.</li>
<li>Branding Cebu is asking what makes it special.</li>
<li>"Puso" or hanging rice should be proudly served in hotels and restaurants.</li>
<li>In this tropical country, designers could come up with a better idea of a formal attire than the preferred western suit.</li>
<li>Houses should be designed with natural ventilation and less air-conditioning necessities, and that low cost houses should mean affordable and functional rather than inadequately cheap.</li>
<li>Unless the highest ranking official of every government agency is able to take the jeepney everyday to work, the problem of traffic will only get worse. Traffic is caused by inefficient public transport resulting to more people buying more cars resulting to more private cars congesting the roads. Road widening is not the answer.</li>
<li>Local government offices should assert on a paperless system of business permit application. One effective office with an efficient system should be enough.</li>
</ul>
<br />
Learning happens when you acknowledge that there is still more to understand. You can never learn enough. And you cannot learn if what you believe is that you know everything.<br />
<br />
The same principle applies. Creativity happens when we learn about what makes an uncreative Cebu.<br />

It was an Orange And Lemons tribute night for POP Shoppe, a regular monthly production organized by Lilystars Records at Route 196.<br />
<br />
Well actually I went to Manila for several reasons. First was to file some papers for a traffic violation I've committed many years back for driving in EDSA without a seatbelt on (yep I've been quietly driving without a license in Cebu mwahahaha).<br />
<br />
The second stop was to watch supposed concert of The Killers. Yes, that concert that got cancelled. This was in January 2010. And for the record, I'm still not happy about the ticket refund.<br />
<br />
And since I'll be in Manila for several days, might as well get some fun.<br />
<br />
Upon finalizing my flight schedule, I've decided to call my friends at Lilystars and asked if I could play in their gigs. Tonet and Lui were very accommodating. They booked me 3 or was it 4 gigs. Hahaha... I didn't realize I had enough guts to present myself as a singer/performer to them.<br />
<br />
And so, the concert got cancelled, fixed my MMDA mess, and ended up at Tonet's place cramming up for the night's gig.<br />
<br />
I had to memorize the chords and the words to <a href="http://draft.blogger.com/">'Hey Please'</a>. Tough. Seriously. It was a tough job for me. I love lyrics and words but memorization is not much my thing. I always almost flunk history classes back in school.<br />
<br />
And so hours passed. I had to keep myself away from distractions just to keep the words in. Hours passed again until gig time. The crowd was warm and enticing. The beer was cold. So many people. I was having fun. And this is exactly what a gig should be - fun.<br />
<br />
So I did. I simply let the audience sing the lines. And this is how I pulled off that one POP Shoppe gig.<br />
